Summary of the Trade & Cooperation Agreement (EU – UK, in respect of Gibraltar)

Section What it covers Key points
Purpose & Scope Establish a framework for trade, customs, VAT, excise duty, social‑security coordination and other areas of cooperation between the EU and the UK (in respect of Gibraltar). • The Agreement is a “single‑document” that replaces the 2008 UK‑EU Trade & Cooperation Agreement. • It applies to all EU Member States and to the UK (in respect of Gibraltar). • It is a “single instrument” – all annexes, protocols and declarations are part of the same legal text.
General Principles Mutual respect for sovereignty, non‑interference, and the rule of law. • Parties must respect each other’s jurisdiction and sovereignty. • The Agreement is binding on all EU institutions and on the UK (in respect of Gibraltar).
Protocols & Annexes The Agreement contains a number of protocols that are treated as part of the main text. Protocol on VAT & Excise Duty Cooperation – information exchange, recovery assistance, and joint enforcement. Joint Political Declaration on Countering Harmful Tax Regimes – commitment to apply BEPS‑related principles.
Key Areas of Cooperation Road transport – licensing, driver cards, tachographs, and road‑transport undertakings. Social security – coordination of benefits, overlapping rights, aggregation of periods, and provisional application of legislation. Customs & VAT – information exchange, automatic and spontaneous data sharing, presence of officials, and recovery assistance. Excise duty – joint enforcement, information exchange, and recovery of unpaid duties. Tobacco – traceability, price monitoring, and joint enforcement against smuggling.
Procedures & Mechanisms Information exchange – written requests, spontaneous exchange, presence of officials, and electronic interconnection of registers. Provisional application – when there is a difference of views, rights are provisionally applied according to a priority order (place of activity, place of residence, etc.). Recovery assistance – joint recovery of unpaid duties, VAT, and excise, with cost‑sharing arrangements. Confidentiality & data protection – all information is treated as confidential and subject to the GDPR and related data‑protection rules.
Final & Transitional Provisions • The Agreement has no retroactive effect on rights acquired before its entry into force. • Rights acquired under the Agreement can be reviewed or resumed within two years of its entry into force. • The Agreement is subject to amendment by the Specialised Committee on the Circulation of Persons.
Implementation • Each Party designates a competent authority for each protocol. • The European Commission acts as a liaison for the UK (in respect of Gibraltar). • The Agreement is published in the Official Journal of the EU and is enforceable before domestic courts.

Bottom line:
The Agreement creates a comprehensive, legally binding framework that allows the EU and the UK (in respect of Gibraltar) to cooperate on trade, customs, VAT, excise duty, social security, road transport, and tobacco control. It sets out detailed procedures for information exchange, mutual assistance, provisional application of legislation, and recovery of unpaid duties, while respecting each Party’s sovereignty and data‑protection obligations.
